Under Florida law, when a creditor receives a judgment against someone, that judgment is recorded in the county records. The recorded judgment then acts as a lien against real property located in that county. However, recorded judgments are not supposed to act as liens on homestead property. In reality, these recorded judgments will act as a "cloud on title" and title companies will not issue clear title to refinance to sell your property if there is a recorded judgment against you.
